{"id":4864,"date":"2012-10-15T02:07:13","date_gmt":"2012-10-14T18:07:13","guid":{"rendered":"https:\/\/www.curtin.edu.au\/news\/homicide-book-to-be-launched-by-curtin-law-dean\/"},"modified":"2022-12-07T13:06:53","modified_gmt":"2022-12-07T05:06:53","slug":"homicide-book-to-be-launched-by-curtin-law-dean","status":"publish","type":"post","link":"https:\/\/www.curtin.edu.au\/news\/homicide-book-to-be-launched-by-curtin-law-dean\/","title":{"rendered":"Homicide book to be launched by Curtin Law Dean"},"content":{"rendered":"<p>Professor Paul Fairall was recently appointed as the Foundation Dean of WA\u2019s newest Law School at Curtin University, but he is keen to share his extensive knowledge of the law with more than just his students.<\/p>\n<p>Professor Fairall will be joined by the Honourable Justice John McKechnie and the Honourable Justice Tom Gray to launch his book Homicide \u2013 The Laws of Australia (Thomas Reuters) on Wednesday 17 October at the Supreme Court of Western Australia.<\/p>\n<p>Professor Fairall says his book will fill an important gap in the widely used encyclopaedia set <em>The Laws of Australia<\/em>.<\/p>\n<p>\u201c<em>Homicide \u2013 The Laws of Australia<\/em> provides a principles-based approach to the law relating to homicide, across all jurisdictions,\u201d Professor Fairall said.<\/p>\n<p>\u201cCriminal law is largely a matter of state rather than federal jurisdiction and the degree of diversity can be problematic, especially for those travelling between different parts of Australia.<\/p>\n<p>\u201cSome states recognise defences that are not recognised in other parts of Australia such as provocation or diminished responsibility, or killing in response to domestic violence, while some offence provisions have no counterpart elsewhere.<\/p>\n<p>\u201cIn WA, for example, if a person assaults another who dies as an indirect result of the assault, the person is liable to imprisonment for 10 years even if the death was not reasonably foreseeable.\u00a0 In other parts of Australia such an occurrence would probably be regarded as accidental death.
